There are two types of criminal charges:

  • Misdemeanor:  A crime less serious than a felony - which is punishable by fine or imprisonment in a city or county jail rather than a penitentiary.  (Examples of misdemeanors are petty theft, trespass, minor assault, etc.)

  • Felony:  A crime for which the sentence for a term of imprisonment in excess of one (1)  year is authorized.  (Examples of felonies are serious crimes such as murder, rape, multiple DWIs, serious assault, etc.) 

Things to do if stopped, questioned, or arrested by the police: 

  • You should always a request an attorney and/or have an attorney present during any police questioning.

  • Never consent to a search of your person, possessions, or property and verbally notify the police that they do not have consent.  That way if the police do search, it will require them to show other legal justifications for the search in Court.

  • Be polite and respectful to the police during any interaction.  Not consenting does not mean preventing the police from doing their job.
